Flash content can be just as dynamic and database/xml driven as HTML.

That argument doesn't hold water for this page as the text on the
page is 90% images.

I don't agree with that. The percentage of people that block flash is
exceptionally low. Flash penetration is something like 98%. I would
feel confident in guessing that the percentage of people that block
flash is well below a fraction of a percentage point.

I'm not sure what the problem is here. I have never encountered
problems with the z-index showing and hiding layers.
